This Seller Privacy Policy explains how [Insert Company Legal Name] ("Winga," "we," "us," or "our") collects, uses, stores, shares, and protects the personal and business data of individuals and entities who register as Sellers ("Seller," "you," or "your") on the Winga mobile application, seller dashboard, and related services (collectively, the "Platform").

This Policy is issued in accordance with the Personal Data Protection Act, 2022 (Act No. 11 of 2022) of the United Republic of Tanzania and its accompanying regulations. It should be read together with Winga's general Privacy Policy (which applies to Buyers) and the Seller Terms and Conditions.

By registering as a Seller on Winga, you confirm that you have read, understood, and agree to the practices described in this Policy.

5. Sharing Your Information

5.1 With Buyers — Your storefront name, logo, product listings, ratings, reviews, and (during Live Shopping sessions) your seller display name are visible to Buyers on the Platform. Your personal contact details (phone number, physical address) are not shared publicly with Buyers unless required to fulfil a specific Order or as part of your storefront's "Contact Seller" feature, which you may configure.

5.2 With Buyers for Order Fulfilment — When a Buyer places an Order, you will receive the Buyer's name, delivery address, phone number, and Order details necessary to fulfil that Order. Important: as a recipient of this Buyer personal data, you have your own obligations under the Personal Data Protection Act, 2022 — see Section 6 below.

5.3 With Delivery Partners — Where Winga's delivery network or Mtaa Agent pickup points are used, relevant Order and pickup information is shared to facilitate delivery.

5.4 With Payment Service Providers — Your mobile money or bank account details are shared with licensed payment processors solely to process payouts owed to you.

5.5 With Regulatory and Legal Authorities — Including the Tanzania Revenue Authority (TRA), the Business Registrations and Licensing Agency (BRELA), the Tanzania Bureau of Standards (TBS), the Personal Data Protection Commission (PDPC), or pursuant to a valid court order or other lawful request.

5.6 We do not sell Seller data to third parties for advertising or marketing purposes unrelated to the operation of the Platform.


6. Your Obligations as a Recipient of Buyer Data

When you receive a Buyer's personal data (name, phone number, delivery address) to fulfil an Order, you act as a data controller or data processor in your own right under the Personal Data Protection Act, 2022, in relation to that data. By accepting this Policy and the Seller Terms and Conditions, you agree to:

Failure to comply with this Section may result in suspension or termination of your Seller account, in addition to any liability you may face directly under the Personal Data Protection Act, 2022.


7. Data Storage and Security

Your information is stored on secure servers with reasonable technical and organisational safeguards, including encrypted data transmission (HTTPS/TLS) and restricted access controls. Where your data is processed or stored outside the United Republic of Tanzania (e.g., by cloud infrastructure providers), such transfers are conducted in compliance with the cross-border data transfer requirements of the Personal Data Protection Act, 2022.


8. Data Retention

We retain Seller account information, transaction records, and payout history for as long as your account is active, and for a reasonable period afterward as required for tax, accounting, audit, and dispute-resolution purposes under Tanzanian law (typically a minimum of five years for financial records, in line with TRA requirements). Verification documents (ID, business licence) are retained for the duration of your registration with the Platform and for the period required by applicable law thereafter.

10. Marketing Communications to Sellers

We may send you communications regarding Platform updates, new seller tools (such as Live Shopping or Group Buying features), performance reports, and promotional opportunities. You may opt out of non-essential marketing communications at any time through your Seller dashboard settings, without affecting essential operational communications (e.g., order notifications, payout confirmations, policy updates).

This Seller Privacy Policy is governed by the laws of the United Republic of Tanzania, including the Personal Data Protection Act, 2022, the Electronic Transactions Act, 2015, and the Electronic and Postal Communications Act, 2010, as may be amended from time to time.
